SIA „DEVOPS”, registration certificate no. 40203152811, registered address: Miera iela 10-32, Riga, LV-1001, hereinafter – the online store – provides the content available on the website and provides goods / services in accordance with the Terms and Conditions set out below.

1. General Provisions

If the consumer purchases goods through the website, then such mutual agreement is considered a Distance Contract and is subject to the legal provisions of the Republic of Latvia governing the distance contract, including, but not limited to, the Consumer Rights Protection Law of the Republic of Latvia, Ministry Cabinet Regulations on Distance Contract etc.

2. Making a Purchase

The prices and specifications of the products sold in the online store are indicated next to the products. Prices are displayed without tax by default. Tax value is specific to the destination country and will appear in shopping cart after shipping address is specified. To place an order, add the desired products to the shopping cart. Fill in all the required fields and choose the most suitable delivery method. The total cost of the order with delivery is then displayed on the screen. Make a payment to complete the order.

3. Terms of Payment

The payment currency on the site is Euro. The purchase can be paid for by choosing the payment methods provided by the payment platform Paysera or by wire transfer.

Personal data required for making payments is transferred to the licensed payment platform Paysera.

The contract enters into force upon successful payment to the online store’s bank account. If for any reason it is not possible to fulfill the order, the Buyer will be notified accordingly, and the amount paid will be refunded as soon as possible, but not later than within 14 days after the receipt of the notification.

If wire transfer was chosen and payment was not received in 5 days, the order is  canceled.

4. Delivery Terms

The order is fully accepted, processed, confirmed and prepared only after we have received confirmation that payment has been made.

We will send a confirmation that we have received the order, order information and order number to the provided e-mail. Check all the details of the order and if any of them is inaccurate, contact us immediately by e-mail shop@devops.care.

If you do not receive an order confirmation within the next 12 hours, please contact us so that we can work together to clarify and resolve the situation.

The delivery fee will be calculated after entering the address and postal code.

The Buyer is fully responsible for the accuracy of the data provided and confirmed by them during the ordering process, as well as for creating the conditions for the delivery and receipt of the order. The Seller shall not be liable for the consequences and has the right to claim damages from the Buyer if the Buyer has not provided accurate data or has not confirmed them correctly, or the Buyer does not accept the ordered products at the specified place of delivery.

5. Right of Withdrawal

By purchasing an item in an online store, you can exercise your right of withdrawal and unilaterally withdraw from the contract within 14 calendar days of the date of receipt of the item.

The Buyer bears the cost of returning the goods, unless the reason for the return is that the goods do not correspond to the order (for example, the wrong product or damaged product).

The Buyer is obliged to return the goods to the Seller without delay, but not later than within 14 days after sending the withdrawal form to the online store. Upon receipt of the returned goods, the online store shall immediately, but not later than within 14 days, refund all payments received from the Buyer on the basis of the Distance Contract.

The Seller has the right to withhold payment until he has received the goods or the confirmation of return of the goods from the Buyer. If the Buyer has chosen a different shipping method than the cheapest shipping method offered in the online store, the online store is not obliged to compensate for the excess shipping costs.

The online store shall not be liable for any delay or non-fulfillment of obligations, or any other type of non-fulfillment due to circumstances and obstacles beyond the reasonable control of the online store.

The online store reserves the right to refuse to sell the goods and request the return of the goods from the Buyer, if the price indicated in the online store is significantly lower than its market price due to an error.

6. Consumer Rights Regarding Defective Goods

The online store is not responsible for defects that have occurred after delivery of the goods to the Buyer. If the purchased goods have defects (incorrect assortment, damaged packaging), for which the Seller is responsible, the Buyer has the right to request the elimination of defects or exchange for new goods free of charge upon receipt of the order before signing the goods handover statement.

The Seller shall provide a written response to the consumer’s complaint within 10 working days.

7. Buyer’s Personal Data Processing

The online store processes only the personal data that the Buyer has entered when ordering goods, such as name, surname, e-mail, etc.

If you have explicitly agreed to receive our marketing communications, including newsletters, we may from time to time contact you by sending you information about our services and the latest offers. For this purpose, we may process the e-mail address you provided when signing up for marketing communications. The Buyer has the opportunity to opt out of marketing communications by notifying us by writing to shop@devops.care.

8. Dispute Settlement Procedures

In matters not stipulated in these terms and conditions, the Buyer and the Seller undertake to comply with the laws and regulations in force in the Republic of Latvia.

The Parties shall resolve all disputes between the Seller and the Buyer by mutual negotiations or correspondence. If the dispute is not resolved in the form of negotiations or correspondence, the Parties will resolve the dispute in the court of the Republic of Latvia, observing the regulatory enactments of the Republic of Latvia. Disputes between the Buyer (consumer) and the Seller may be referred to the Consumer Rights Protection Centre or a court of the Republic of Latvia.

The Buyer also has the right to apply to the European Union dispute resolution bodies.
